Howe lawsuits update: Horrigan, Wolf complaints will proceed to trial
Earlier this month, summary judgments were issued on the lawsuits filed against the City of Toledo and former Police Officer Kyle Howe. Three cases were ruled on, two of which will go to trial.
The lawsuit brought against the City of Toledo and Howe by Shyla Wolf will proceed to trial. This stems from the incident in March of 2023 when Howe took Shyla Wolf to the ground during a traffic stop. Two counts of excessive force are claimed against Howe along with four counts of battery and five counts of assault. Eight counts of respondeat superior are claimed against the City of Toledo for the assault and battery claims. Respondeat superior is a legal doctrine where in which the employer may be held responsible for an employee’s wrongdoings.
The other lawsuit heading to trial comes from Steven Horrigan, who was 72 at the time of a traffic stop in March 2023 in which Howe took him to the ground. One count of excessive force is claimed against former Officer Howe along with, three counts of battery, and four counts of assault. Six counts of respondeat superior are claimed against the City of Toledo for assault and battery. Since the lawsuit’s filing, Mr. Horrigan has passed away, and his family furthers the lawsuit on his behalf.
The lawsuit brought by Lang Leonard against the former officer Kyle Howe and the City of Toledo was granted a summary judgment and will not be going to trial.
